This comes directly after a fatal car crash in late March caused by the incorrect use of assisted driving features.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For years, automakers and technology suppliers had been promising <em>autonomous<\/em> or <em>smart<\/em> driving, but real\u2011world performance often lagged behind the marketing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New measurements shared by the MIIT are not just headline\u2011grabbing restrictions. They represent a fundamental shift from bold claims to verifiable safety.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Management teams working on advanced driver\u2011assistance systems (ADAS) in China must understand the new rules, adapt product roadmaps and supplier strategies, and prepare for a regulatory climate that values evidence over hype.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This article summarises the regulatory changes, explains their technical meaning, compares global frameworks, and analyses how companies like BYD are responding.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What does the Regulation Demand?<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Advertising discipline and ban on inflated terminology<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">MIIT told automakers to stop using terms like \u201csmart driving,\u201d \u201cintelligent driving,\u201d or \u201cautonomous driving\u201d when marketing Level 2 systems.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Only explicit SAE\u2011level language, such as <em>L2-assisted driving<\/em>, is permitted. The Ministry of Public Security later <a href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/china-bans-smart-autonomous-driving-terms-vehicle-ads-2025-04-17\/#:~:text=SHANGHAI%2C%20April%2017%20%28Reuters%29%20,a%20transcript%20of%20a%20meeting\">signalled<\/a> that overselling ADAS could violate China\u2019s Advertising Law, which allows fines of three to five times the advertisement cost, or CNY 200 000\u20131 000 000 when the cost is hard to determine. Misleading promotion can also lead to suspension of business licences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For management teams, this means that communication strategies must be cleared with legal counsel; marketing content, owner manuals, and dealer training must reflect the new nomenclature to avoid penalties.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Public testing and feature restrictions<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Previously, some companies used <em>pioneer user<\/em> programmes to test new functions on public roads. The draft (September 2025) emphasises human\u2011machine interaction, cybersecurity, and data recording.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It mandates hands\u2011off and gaze-monitoring, requiring the system to issue warnings and temporarily disable itself for repeated non\u2011compliance.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yicai Global <a href=\"https:\/\/www.yicaiglobal.com\/news\/china-solicits-feedback-on-draft-national-safety-standards-for-l2-driver-assistance-systems#:~:text=%28Yicai%29%20Sept.%2018%20,opened%20it%20to%20public%20comment\">notes<\/a> that the draft also calls for the vehicle to record key data for accident investigation and to disable itself for at least 30 minutes if warnings are ignored.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These requirements mean suppliers must upgrade steering\u2011wheel sensors, camera\u2011based driver monitoring, and analytics for logging behaviour.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">OTA updates and recall procedures<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most significant changes is the way China now treats software updates. In February 2025, the company <a href=\"https:\/\/ev.com\/news\/byd-introduces-smart-driving-with-gods-eye-system-across-vehicle-lineup-at-no-extra-cost\">announced<\/a> it would equip 21 models with its God\u2019s Eye driver\u2011assistance suite, offering the system across the entire lineup at no extra cost.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BYD\u2019s chairman, Wang Chuanfu, said that \u201cgood technology should be available to everyone\u201d and predicted high\u2011level smart driving would become as essential as seatbelts and airbags within two to three years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The system is tiered: <em>God\u2019s Eye C<\/em> (DiPilot 100) uses 12 cameras, five millimetre\u2011wave radars, and 12 ultrasonic sensors; <em>God\u2019s Eye B<\/em> adds LiDAR; and <em>God\u2019s Eye A<\/em> employs three LiDAR sensors with the powerful DiPilot 600 computing system. It also deepened its LiDAR supply relationship with Hesai, announcing that more than ten models in 2025 would carry Hesai units. Standardised hardware reduces the number of approval permutations when regulators review changes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Accepting liability for bounded domains<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Perhaps the most striking response was BYD\u2019s <a href=\"https:\/\/www.reuters.com\/markets\/emerging\/byd-makes-safety-pledge-cars-with-proprietary-assisted-driving-china-2025-07-09\/\">decision<\/a> in July 2025 to assume responsibility for any accidents or losses arising from its smart parking feature. The company stated that users would not need to go through insurance; BYD would handle claims directly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The smart parking function is described as having Level 4 capabilities in confined areas, allowing the driver to take their hands and eyes off the wheel under certain conditions. By assuming liability, BYD signals confidence in its technology and seeks to alleviate regulator concerns about unsupervised features.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This risk\u2011transfer strategy mirrors Mercedes\u2011Benz\u2019s approach with its Drive Pilot Level 3 system in Germany, where the manufacturer accepts responsibility when the system is in control. For other companies, the lesson is that carefully bounded features with manufacturer liability can earn regulators\u2019 trust.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Balancing innovation and caution<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Chinese regulators have indicated that they still support innovation. A Reuters report noted that officials aim to resume Level 3 validation tests in 2026 and are working with companies such as Huawei and Changan to draft safety rules for higher levels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same report noted that more than 60% of new cars sold in China in early 2025 had Level 2 features. BYD\u2019s approach\u2014scaling Level 2 features while building the groundwork for Level 3\u2014aligns with this timeline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company rolled out God\u2019s Eye across its range for free, creating a massive fleet of vehicles that can collect data and improve algorithms. With regulators limiting public beta programmes, BYD\u2019s in\u2011house data becomes even more valuable for closed\u2011loop improvement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">China\u2019s 2025 directive ended the free\u2011for\u2011all era of assisted\u2011driving marketing and demanded proof instead of promises. By banning inflated terminology, restricting public betas and unsupervised features, mandating hands\u2011on detection, and regulating software updates, MIIT reset the industry\u2019s priorities.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The changes align with global movements in Europe and the United States, where regulations like <a href=\"https:\/\/unece.org\/media\/press\/395206\">UNECE DCAS<\/a>, <a href=\"https:\/\/www.euroncap.com\/en\/press-media\/press-releases\/euro-ncap-announces-2026-protocol-changes-to-tackle-modern-driving-risks\/\">Euro NCAP\u2019s 2026 protocols<\/a>, and <a href=\"https:\/\/greyb.com\/blog\/navigate-automatic-emergency-braking-rule\/\">NHTSA\u2019s AEB rule<\/a> push for robust driver monitoring, low\u2011light performance, and evidence\u2011based safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For ADAS management teams, the reset is an opportunity to build better products. BYD\u2019s response shows that companies can adapt quickly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Others must follow by aligning language and HMI, building regulator\u2011ready evidence kits, stabilising hardware, integrating driver\u2011monitoring from the start, and engaging regulators and customers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Looking ahead, the next three years will likely see China approve the first Level 3 systems under strict supervision, global convergence on driver\u2011monitoring and dark\u2011scenario performance, consolidation among suppliers, near\u2011universal adoption of ADAS, and new data\u2011governance rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those who invest in evidence and trust will not only comply with China\u2019s hard rules but also gain a strategic advantage worldwide.
